How Workers' Compensation Fees Work
Lawyers are required by law to provide a written fee agreement at the time an injured worker engages their services. Moreover, all fees charged in such agreements are subject to the approval of a workers' compensation commissioner, whose job is to ensure the fair treatment of workers.
In most cases, attorneys work on a contingency fee basis. What this means is that they do not collect any fees unless your case is successful. And, if they are able to collect restitution on your behalf, their fees will typically be limited to 20 percent of the return. There are some instances where attorneys are permitted to charge up to 25 percent — but the worker must agree to such arrangements, and they are contingent upon a number of restrictive factors.
